Florida Pre-Settlement Funding Laws and Regulations

Florida’s personal injury rules changed when House Bill 837 was signed on March 24, 2023. These rules apply to accidents on or after that date, and they affect how we review every Florida lawsuit funding request. Confirm timing with your attorney before relying on any deadline below.


Statute of Limitations for Personal Injury

  • General negligence: 2 years from the date of injury [1]
  • Medical malpractice: 2 years from discovery, 4 years maximum from incident
  • Wrongful death: 2 years from date of death
  • Product liability: 2 years from injury or discovery

HB 837 reduced the general negligence SOL from 4 years to 2 years for incidents on or after March 24, 2023.


Minimum Mandatory Auto Policy Limits

  • Personal Injury Protection (PIP): $10,000 [2]
  • Property Damage Liability (PD): $10,000
  • Bodily Injury Liability (BI): not required by statute

Florida is a no-fault state. PIP pays first up to $10,000 regardless of fault. Florida is one of only two states that does not mandate bodily injury liability coverage.
